Default Police and insurance

I got tugged by the plod lastnight driving Amy's saxo and he said the reason he pulled me is because of the car itself and that he thought id been drinking! Anyway he then say im not insured to drive the car! I have the insurance certificate for that car with my name on it but he claim it wasnt on there database and Amy is only allowed to drive? The insurance was set up friday with admiral as a multi car policy so that i can drive the vectra and saxo and Amy just the saxo. The thing thats pissed me off is he wanted to cease the car but didnt as Amy could driver it and he has nicked me and making a court case so i get another 6 points on my license and a £200 fine when i already have 7 and the F**KING insurance certificate he had in his hand to prove im the policy holder and im the main driver on that car aswell as the vectra! rant over sorry about the essay but i think its very unfair.

nothing to worry about if you have got insurance, i know that the motor insurance database doesn't update immediately. however, if not,you're fucked

obviously don't let it lie and get it all sorted. Get in touch with the insurance company etc. and verify the details to the police.

If you're are insured, take the info into a station and explain.

If you say you was insured from the policy then you'll be fine.

I think it could be because Amy has the saxo insured with diamond and mine admiral and i put the saxo on mine friday as a multi car with Amy on it they havnt updated to say that i have a multi car policy because he said the saxo has insurance held by Amy and the vectra has insurance held by me. Hopefully the insurance havnt fucked up because il lose my license because of them, It cost me £180 deposit friday and then £185 a month then onwards!! noooway id be paying that much for an old vectra diesel. Plus i had the certificate that he read that has my name on it :@

The traffic cop said to ring the insurance today and get them to post you some form of proof to send to courts when you recieve the summons.... which i will ring and do but im pretty sure the insurance certificate is proof? he had this in his hand.

Yeh but the diamond has got to be cancelled tomorrow, this is why i think he thinks im not insured because he has pulled that policy up. He took my reg on the vectra and said im on as a named driver. If you see were im coming from he checked the insurance for each reg? I know im legal on it but its just hassle i dont want going to court etc. He said if he see me out in it again he will arrest me and have the car ceased and crushed?! Im legal to drive it so i think i could sue them if they did and claim a new car.

Afaik a car can only be insured once, and I would expect the oldest policy would be the valid one so in theory you may not of being insured

Should if cancelled the other policy when you took the new one iut

I know it shouldnt have 2 policy but the policy i started began friday and was paid so technically im legal to drive the car. Say for instance the previous owner was a clown and continued to insure the car my policy would be void?

You can't have two policies running at once unless I am mistaken.

Unsure where the law stands in regards to which policy would be the valid one, need someone who knows the law on this one.

If the oldest policy is the valid one then you were not insured.

If it doesn't matter as long as you have a policy in your name then you would be insured and there is nothing to worry about.

Once you show the proof of insurance to the court, they will make a decision.

I reckon you will be fine but it's probably not as straightforward as you think if you have two policies running at the same time.

I cant disagree with you on that but they have still got to take into account that i have paid my insurance to legally drive the car so im not technically breaking the law im not wiser that it has other insurance. If you see what i mean?

I do see what you mean and I agree that it shouldn't matter as long as you have valid insurance but it will be upto the court to decide.

Did the police officer know you had two policies running?

Would have been best not to have told him/her about the other one and the court would have then just thought the database hadn't updated as long as you could prove you took out insurance previous to getting pulles.

I think the problem lies with who would have paid out if amy had crashed today or yesterday. She would be insured by both companies therefore both would be passing it to the other company and thats probably why isurance would be void if you have 2 policies. Regardless whether you've paid it or not. I'd seek some legal advise to check where you stand mate.

True bit i was driving the car so if in crashed etc it would be my insurance.

If you read the bit at the bottom were it say your name must be in section 5 my name is and the officer clearly saw this.

An insurance certificate means next to nothing. Well known scam is to insure a car, receive a certificate and then cancel the policy.

You still have a certificate but no insurance.
