Is the amp set to come on only when the head unit is turned on or is it on all of the time?

Check as above, and possibly check your alternator.

is the amp turning off when you turn ignition off and have the keys out, seems liek you have something connected up to the permanent live

But as Ste said (Predator) it could be the fact your running a permanent live to your amp, therefore when you remove keys from ignition your amp and sub are still live so will kill your battery. Who wired it all up?
