unfair parking ticket, what can I do?
Right this is along post to explain but PLEASE stick with it as I could do with advice, cheers
Rite i live in newcastle & the area where I live has parking bays at the front which u have to pay & display for or have a permit, however there is private parking to the rear of the property which u need a electronic key fob to opperate the barrier to gain access. As there are 3 people with cars living in my house and ur only issued with one key fob, it means no sole person can retain it, so it has to be left in the house.
THE STORY
So one morning i pull up outside my house into one of the parking bays, to go into my property to collect the key fob which allows access to the private parking, I was in my house minutes while searching for the key fob, & notice out the window a traffic warden writting me a ticket, so I ran out and explained to her that I had no intention of parking and was mearly looking for my parking fob she said it was a legal binding document & once it had started to be issued could not be revoced and i would have to apeal in writting!
So i sent a letter of apeal explaining that I was in my property a matter of minutes & that I was looking for a fob to allow me access to my private parking facilites. I recieved no response and about 2 weeks later recieved a letter which was basically a payment reminder so i sent the letter again & herd nothing back for 3 month. Then today I get a letter from the council's legal service department saying I've got 7 days to pay or be taken to court!
Is there anyway I can protest this without going to court?

thats a joke that is , id probably just pay it, depending on how much the ticket is, if it was more than 60 quid id go to court to protest, then again they may say, u shud have left your car legally parked somewhere else. theyl use any excuse to get ur money. i dont know
sorry

did you send the letters recorded delivery?
If yes, ring the cunts up and laugh arrogantly down the phone to them.
If no...
bad times, you'll have to protest in court.

Just pay and hope its only £30.
Councils are really frustrating when it comes to things like this. If you appeal it will probably be rejected and you'll have to pay anyway.

Similar thing happened too me, well basically I rent a student house with resident only parking outside and you need a permit, However in order to get a permit you have to have you're vehicle registered / insured, & that house on you're driving licence. Well this is retarded as it would push my insurance up as its a rough as fuck area etc...
I got a ticket one day and appealed saying this and they just told me its illegal to have a car parked in a bay that is not displaying a ticket. pay or go to court.
You can argue all you like but im pretty sure you will just ave to pay in the end soz mate

Unless you sent your letters recorded and have record of this, you've not got much to go on tbh. It might just be easier to pay the fine, although after 3 months I'm guessing its going to be more than £60.... Sorry fella.

Interesting read. Click me
Unfortunately the above link is not intended to challenge Council or Police issued PCN's, however there may be something of use to you in there.
If your car was parked, even for a few minutes in a clearly marked area then the issuing warden has every right to issue a ticket, however there will be a million and one loop holes you can use to get out of the fine.
I would visit http://www.consumeractiongroup.co.uk...ffic-offences/ for further information and advice. Make sure you read the stickes as there are some very cleverly written templates you can use to write to the issuing body
Hope that helps

Just for reassurance, I used to park in an area that I clearly wasn't allowed to park in every day in a City Centre I used to work in. Every day I received a ticket and each ticket I appealed on the basis the signs were not legible.
There is always a case for appeal if you know the ins and outs

ye when I originally got the ticket I sent a letter to appeal it, didnt hear anything back, think ur suppose to get a letter either accepting ur appeal or rejecting and a reason why, I didnt recieve this letter, they have just past my details straight onto there legal department and said because my case was rejected, but im sure they have missed a stage out and I should be able to appeal again yet!
