Turned my console on for the 7th time since i bought it.

Had 1 match on the new game COD4. it crashes. Now wont read discs.

Xbox unreliable??? hahah please. My never failed in over a year.

PS3 fucked under 2 hours of gaming.

On these grounds i can i take it back?

I will take it back to HMV, say i would like to exchange for a 360 elite. So i have no faith in the console now.

Will they do that or just replace it?

Probably replace it, is it within 28 days? If so you're entitled to a refund, over that it's at their discretion,

they will change it mate as it has a 12month gurantee either for another ps3 or for a xbox 360 for a similar price

As it's within 28 days you should be able to get a full refund, as it's faulty, down to manufacturer's error, or a replacement etc...

With sat nav's etc that's how we work, and that's halfrauds, so the least they can do is refund.

Just bought COD4 for ps3 too. I doubt asda will give a refund on a game. Hopefully they will swap it for a 360 version of COD

you are well within your rights to take it back.

you can legally sue HMV for the price of the console because they didnt meet their Legal Obliagatory duty of care to provide a product that met your standard.

Pretty shocked about this to be honest, there is only a couple of things that the ps has to build a good foundation on..

There fucked if the rumour about 40% of the 40gb models being defective..home is also delayed, going to give it until christmas and see for any updates, if nothings changed i'll throw the towel in and buy an eggbox elite..

no, wouldnt win a court case. it is expected to get a few faulty products in the batch.

but well within his rights to a refund from the retailer

and if u have the receipt, i would say entitled to full refund.

if they say no, stamp ur feet, cry and sulk in the corner!

Yes, refund is definate, within 28 days is the proper time almost anywhere, unless its games etc as they've been opened.

I have the receipt here in my hand

Bought on the 26th of Oct at 12:41 for the total of £310

Tbh i dont want another PS3. the Internet side of it is wank, it broke after 2 weeks etc etc.

I know tomorrow will either bring another ps3 or a 360 elite but just scared they will ONLY give me a PS3

Incorrect. you could win the case if it went to court.

its covered under Contractual Negligence law.

the case you would reference is

Donoghue and Stevenson from the 1920s based upon a woman who drank a drink with a snail in.

She sued the manufacture for not meeting thier quality standards.

You brought a PS3 for £300ish.

you expected a level of product that worked.

They have a Duty of Care to provide product that works within a resonable lifespan

they have breached that witha product that last 2 hours out of an expected 100s.

The resulting damage is the cost of you having a £300 loss aswell as stress and transport costs of carting the thing around.

edit: you are entitled to a FULL refund. not a shitty voucher. You can then buy the elite
