1 week 1 day... Bang. Crash.

Just thought id let you all know ive crashed my beutiful car.
The car's no doubt a write off, il post a couple pics in a min.
Can i make it clear that the accident WAS NOT MY FAULT. before i get the "oh hes only 17 he was guarenteed to crash it". Cos that really anoys me. Especially as the crash was not my fault.
What happened?
Well i was going down fleetwood road, blackpool, doin the speed limit, then calagran (caravan site) entrance was coming up, and no cars were around. So i carried on driving down the road, got near the caravan park entrance, and a black mercedes with personlised number plate came to the giveway line, and pulled out infront of me doing about 5mph. He clearly didnt look before pulling out.
A car was comin down the other side of the road so only choice i had was to go up the pavement. So as he pulled out in front, naturally i hit hard on the brakes, skidded up the kurb, then saw a man stood there so turned my wheel and crashed into a fence. If i did not turn, the man would be in hospital right now.
The man in the mercedes drove off, did not stop at all. My brother was behind me in his VTR, he pulled up, my mate jumped out his car and checked if i was ok, and i shouted at my brother to go after the guy. So i brother speeded after him and got him to come back.
The man (witness) has gave the police a statement, saying i was driving sensibly and that the owner of the mercedes is fully to blame.
The mercedes owner is acting all innocent like he hasnt done anything.
I didnt hit the merc, or anyone, just a fence, not alot of damage to it so i doubt they will claim off me. Not sure yet.
Im seriously hoping i will be able to claim on his insurance. My mate who was in the car with me has whiplash and is wondering if he will be able to claim on the other guys insurance, hes told me he will not claim if it goes through my insurance. Anyone know whos insurance it will go through?
Gunna have a day off tomoz, as i have backpains/stiffness in neck and a head ache still. So i should be able to fone insurance companies and find out abit more.

..Seriously hope i can claim on his insurance.. The police officer said i have a strong claim especially with an eye witness.

unlucky mate, tbh if someone pulls out like that its reaction to try and turn out the way but i think in this it would of ben best to just slam on and maybe hit into the merc....

My brother took ages getting him back, i thought my bro had pulled him over and gave him a beatin. lol. But it just turned off he was trying to get away n my brother caught him up and forced him to stop lol.
I really do hope i can claim on his insurance

I dont want to put you off but there is no way you can claim off the merc's insurance, also if your mate wants to claim he has to claim on your insurance

Take it all the way mate... dont say sorry, or anything that will make it look like your fault. (i know it wasnt, but they'll have anythin like that to use against you)
or find out who he is, go round and beat him (well hire someone) he'll soon please guilty

Hmm gd gd,
The guy who towed my car away gave me a card and told me to ring them , its a no win no fee thing, and he said they should be able to make a claim on the guy. Also he said im better off using this than using my insurance because my insurance company will take 'forever and a day'.
So tommorrow, il ring my insurance company up, tell them iv been in an accident, then ring the number on the card he gave me. Give them the log number and that, explain.. and hopefully they'll be able to sort me out

Dont know if im claiming for whiplash yet, as i've only got little stiffness in my neck and little pains in my back.
Will be able to tell if i need more time off work and if i need to see doctor by tomorrow morning.
