from the donoghue case u have mentioned then.. it was a case of negligence. i.e the snail.
there was no negligence with leckie's PS3, just an unfortunate thing to happen.
anywya, as if he would need to sue...

There is no need to sue because he is full within his rights to a refund.
The case is a text book example of neglience.
the fact that the manufacture didnt bother to make quality item is negligent.
The case does refer to an example outside of contractual law.
If Leck took his console back, he is infact entitled to a full refund because part of the conditions of buying the ps3 is to
1. provide money on leckies part
2. Sony/HMV to provide an item of a minimum quality which they failed to do.
They have therefore broken a condition of thir contract with thier customer

Took it back. Kid said he wouldnt refund me. I asked for the manager, She tried telling me the same. After 5mins she agreed.
Now got a 360 with a hdmi port :d woop

awesome stuff man, Im still a ps man at heart (having never played a 360 or a Ps3  ).. but i still cant get over the fact htat konami brought out a game that was practically unplayable.

You probs got a bad seed mate, our PS3 has taken unreasonable abuse and hours of gameplay from my two little bros, not a stitch has gone wrong, even when rinsed by a 8 year old kid. X360 is decent and better value but one thing to remember, next March GT5 coming out for PS3 only and on it will be the TOP GEAR test track plus the inclusion of Ferrari. I've heard many X360 owners saying they'll get a ps3 just for that one game....

gt and gta is the only reason i bought it.
anyone thinking of buying one should wait a good year i reckon,shite games out atm

Agree in part that not many decent titles are on the PS3... yet. There will be though, so yeah best to wait a little til the price drops and the big games come out. Apparently there's also talk of a new compact PS2 with it's own in-built power supply (wtf?!), saw it in a tech mag at work, should be interesting.

gta is delayed because the ps3 cant read discs as fast as the 360.
i brought my 360 purely because i couldnt find a wii for sale near me.
Glad i went 360 now . love it
