haha i've just seen this thread. sorry oz.

its quite hard to pin it down to legalities. your best bet would be to approach the local authority and ask them the question. ask them how high a fence can be before a planning application is to be made.

they say that anything over 2m, a planning application is required, so it doesn't mean it's illegal if the fence does go over this height. it just means consultation with the local planning authority is required.

and also, if you obtain any type of confirmation from the local authortity/council, make sure you have something in writing confirming your proposals... e.g.

"dear mr osborne, we confirm that a planning application is not required for the proposed 2m high fence"

put this letter with the deeds, so that when you come to sell the house, if the selling agents/surveyor picks up on it, then you have it in writing that the necessary procedures were carried out.

good stuff damo, it's for my parents though.

and afte speaking to the local authority, it's 1.35 metres, and ours is 1.55 metres, so it's 100 quid for the application or 500 to get the fence lowered.

MUM WANTS IT LOWERED!!!!

why doesn't your mum take the easier option and keep the fence at the same height and pay £100 to make an application? is she worried that neighbours or some people would object?
