New car, no log book?
Morning lads.
I’ve got a question regarding car ownership. I’ve recently purchased a runaround to hopefully use through winter, however, the guy I bought it off was a bit of a prick. I’ve had the car a month or so now but I’ve still not received the log book. I checked online and the car is still taxed. So he’s not sent the log book off (which is strange – because he’d get about £140 back under the new law). So I can’t tax it, and I don’t have the log book showing I own it. Obviously I’ve contacted the seller regarding this, but he’s ignored me. I have the green slip we signed when I collected the car and I’ve done a bit of Googling which suggests I have to fill out a V62, but short of going round to his house and shitting through his letter box I’m not sure what else to do?

This is right - I had to do it once and because its technically the sellers fault you shouldn't have to pay.
What car is it out of interest?

£25 I think it is?
Ring the DVLA who can confirm if they are in the process of sending a logbook out. Mine took 7 weeks the slags and I still haven't got my plate on yet

That’s what I thought. One of my friends didn’t send his log book off and he had all sorts of trouble from it, including fines and red letters.
And it’s a sax, of course.

It is £25 according to the V62. I’ll give the DVLA a ring this afternoon and see what they say.

That's the form - read section D. It states you do not need to pay if you have the green slip and you are the new keeper.
I got mine back relatively quick when I had to do it.

Tax the car first, if you can? Otherwise while they change it over the car wont have tax and you will have to wait until you get the V5C back. Confusing situation.

I can’t tax it without the document, however it is still taxed by the previous owner so I could just get insurance and drive it. I don’t need it just yet, my daily is up for sale but when it sells I'll need something to drive.

You can tax it without the main V5 using the green slip, but once you send that off you'll have to wait until you get the main V5 back before you can use it.

Ah right. What happens to the tax that is already on there? I’ve just phoned the DVLA but they couldn’t verify if they have received the documents or not.

I'd be inclined not to kick up a fuss at this point.
You don't actually 'need' the logbook for anything, and you have the V5C for the car.
I'd just keep using the car with the tax which is on it - when the V5 gets processed (assuming the guy has sent it back) the tax will come off and go back to him.
If he's not sent it back - surely its as well to use the tax which is already on it rather than pay extra to cover a month which he's already paid for.....
Makes sense in my head - although theres maybe a good reason why it wouldn't work.
The new law is crooked as feck when it comes to change of ownership.

Why are you making it so complicated??
All he needs to do is fill in and send off the v62. As long as he taxes it (which you can do with the green slip), there's no other issues. You don't have to wait for the V5 to be in your name to drive a car you know.

I'm unfortunate enough to work for the dvla as of two months ago, and as everyone else said all you need to do is send off section 10 (green slip) and a v62 you can tax it with this at the same time so you can drive.
there will be no fee under the circumstances you describe
