Default whos fault ?

mate of mine has a 1.1 106 and the other day coming home from the beach his car made a loud pop and hissing then stopped and drove fine then as we got into his street did it again do we pulled up and checked the usual , oil water etc. then it started knocking like hell so he limped it to the nearest garage who said gearbox is on its last legs, so he ordered a recon box and new clutch and took his car to a gearbox speicialist to be fitted who rang him 4 hours later saying that the timingbelt has snapped but your gearbox and clutch are fine , will the garage have to pay for engine repairs seems they were the ones who broke the belt ?
